When a blue van with the Amazon Prime logo causes a crash, serious injuries or a death, the shopping and delivery giant runs from any responsibility and accountability.
“These people are not Amazon employees” is the pattern response of Amazon. Despite the Prime logo on trucks involved it is consistently claimed that the drivers and the companies are independent contractors.
Litigation and various forms of investigation have shown that the Delivery Service Partners (“DSP”) have various controls placed upon them by Amazon.
Amazon requires that the drivers operate vans with the Prime logo prominently displayed. They must also wear uniforms with the Prime logo. Amazon pays for the vans fuel, their routes and mapping are provided and controlled by Amazon.
Hiring rules are in place by Amazon. It provides training to the drivers. Amazon reserves the right to discipline and terminate drivers. They track van operations and the Amazon Flex App.
I believe that based upon undisputed facts, that Amazon controls the means of methods of the DSP delivery drivers.
While cases involving DSP vans and their drivers continue to provide more facts regarding the controls of Amazon and its responsibility for the injuries and damages, a recent jury has held Amazon responsible and issued an award for damages.
I believe that the claims against Amazon involving DSP vans will become stronger with more effort and work to hold them accountable.
